Terms of service

Draft

Draft — the text is still being reviewed by a lawyer.

Version: draft of 3 October 2026. Details in square brackets are not filled in yet or still need to be confirmed.

Who we are

The Buqtivity online platform (the buqtivity.com website and related services; "Buqtivity", "we") is run by [Business name], OIB [OIB], registered at [Address]. You can reach us by e-mail at [E-mail] or through the Contact page.

[for the lawyer: add the mandatory details of the service provider (Croatian E-Commerce Act, Businesses Act): register court and registration number, share capital, members of the management board, VAT number, bank and IBAN.]

These terms govern the use of Buqtivity and apply to everyone who uses it: visitors, customers and organisers. Organisers are also bound by a separate partnership agreement. [for the lawyer: the agreement with organisers does not exist yet; align it with these terms.]

What Buqtivity is

Buqtivity is an online marketplace (an intermediary platform) where local activity leaders, sole traders and businesses ("organisers") offer outdoor and leisure activities and events: tours, trips, workshops, camps, journeys and similar programmes. On Buqtivity you find these activities, book them and pay for them.

Your contract for taking part in an activity is with the organiser, not with Buqtivity. The organiser is the provider of the service: it is responsible for running the activity, for the participants' safety, for the permits and insurance needed and for the accuracy of the description, price and terms it publishes. The organiser's name is shown on the event page and in the booking confirmation.

On the organiser's behalf, Buqtivity takes bookings and collects the price, sends confirmations and notices, carries out cancellations and refunds under the event's policy and helps you if something goes wrong. [for the lawyer: the payment model (whether Buqtivity collects in the name and on behalf of the organiser) and who issues the invoice to the customer are not decided yet; align this paragraph.]

Only registered businesses may sell paid activities. As a consumer you have all the rights the law gives you against them. [for the lawyer: whether people who are not traders may publish free activities; if so, the customer must be told on the event (Directive 2011/83/EU, Art. 6a).]

Order of listings. Event lists are sorted by date, popularity (bookings in the last 30 days and ratings), newness or price, depending on the list; you can change the order in the filters. Paid listings are marked as sponsored. [for the lawyer: check the description of the main ranking parameters (Directive 2005/29/EC, Art. 7(4a)).]

Your account

An account lets you see your orders, cancel, write reviews and save favourite events.

Accounts are for adults. The details you enter must be accurate and your own. Keep your password secret: until you tell us about misuse, you are responsible for what is done through your account. [for the lawyer: the age limit for an account (18) and bookings for underage participants.]

Activity leaders and businesses can sell only after Buqtivity has approved them.

You can delete your account in the account settings or by writing to [E-mail]. Your orders are then kept without your contact details, as far as the law requires (e.g. accounting rules).

We may restrict or close an account that breaks these terms or the law (e.g. fake bookings or reviews, payment abuse); we tell you so and give the reason.

Booking and payment

  • On the event page you choose a date, the number of participants and any extras (e.g. gear rental). Before paying you see the total price, the organiser, the cancellation policy and these terms.
  • The contract with the organiser is made when, after a successful payment (for free events: after signing up), you receive the booking confirmation by e-mail. The confirmation and the details are also in My account → Orders.
  • You pay by card through the payment service Stripe. You enter your card details directly with Stripe; Buqtivity neither sees nor stores them.
  • Some events have a minimum number of participants and a deadline for reaching it. If not enough people sign up by then, the date is cancelled and you get everything you paid back.
  • An event published as an announcement cannot be booked yet; you can save it and be notified when booking opens.
  • A pack of visits is bought from one organiser and used for that organiser's dates until it expires. A membership with an organiser may give you special prices or priority booking; the organiser sets the membership terms.
  • The same terms apply to trips abroad; the organiser describes the departure, transport and accommodation. [for the lawyer: a trip with transport and accommodation may be a package travel (Croatian Act on the Provision of Tourism Services); it may then be sold only by a travel agency with insolvency protection and with specific information for the traveller. Check and align.]

Prices and fees

Prices are set by the organiser. They are shown in euros and include value added tax and all mandatory charges; the amount you see before paying is the amount you pay. [for the lawyer: organisers outside the VAT system, and the tourist tax for multi-day programmes.]

Buqtivity charges customers no booking fee and no surcharge for paying by card. Buqtivity charges the organiser a commission on sales.

Coupons and discounts apply under the conditions shown with them and cannot be exchanged for money.

Cancellations and refunds

Every booking follows the event's cancellation policy shown on the event page and in the booking confirmation, as it was when you bought it. All policies, deadlines and how refunds are paid are described on the Cancellation and refunds page, which is part of these terms.

Activities on Buqtivity are leisure services for a specific date, so there is no 14-day right to withdraw from a distance contract (Directive 2011/83/EU, Art. 16(l), and the Croatian Consumer Protection Act). Packs of visits and vouchers that are not tied to a date can be cancelled within 14 days of purchase, as described on the cancellation page.

If the organiser cancels a date or the whole event, for any reason, you get everything you paid back, extras included. The refund goes to the same payment method within 14 days at the latest.

The organiser's changes and messages

The organiser must tell you in good time about any change that affects your booking (e.g. the time, the meeting point, the programme). We send these notices by e-mail, and they are also shown in your order.

If the organiser changes the date, the place or the content of the activity significantly, you can accept the change or cancel the booking and get everything you paid back. Minor changes that do not alter the nature of the activity (e.g. a nearby meeting point, or another equally qualified activity leader) give no right to a refund. [for the lawyer: what a significant change is, and how long the customer has to answer.]

If the activity cannot be run safely because of the weather or for safety reasons, the organiser may cancel it; you then get a full refund or, if the organiser offers one, another date, as you choose.

The organiser may send you messages needed to run your booking (meeting point and time, gear, weather, cancellation). Messages after the activity has ended (e.g. photos, a thank-you) are sent only if you agreed to them when booking, and for at most 7 days after the activity. You can change your choice in your order.

Reviews

You can rate an event (1 to 5) and write a review. Each customer writes one review per event and can edit it later. Reviews are public and show the name you enter as the author.

A review written from the invitation after a booking, or linked to your order, is marked as a verified booking; other reviews are not verified. We do not pay for reviews, and organisers cannot delete or change them. [for the lawyer: the information on how reviews are checked (Directive 2005/29/EC, Annex I point 23b and Art. 7(6)), and whether people without a booking may write reviews.]

A review must be truthful and about your own experience. We remove reviews that are unlawful or offensive, contain other people's personal data or advertising, or are not about the event. Ratings count towards popularity and so towards the order of listings.

Conduct and safety

  • Before booking, read the description, the intensity, the requirements and the gear list, and judge whether the activity suits your health, fitness and experience.
  • Follow the instructions of the organiser and the leader during the activity. The organiser may exclude a participant who puts themselves or others at risk (e.g. under the influence of alcohol) or does not meet the published requirements; the event's cancellation policy then applies. [for the lawyer: a refund in that case.]
  • A parent or guardian who signed up underage participants is responsible for them, unless the event description says otherwise.
  • It is forbidden to make fake bookings or write fake reviews, to abuse payments, to publish unlawful content or content of others, to disrupt the platform, to collect data from the site automatically and to get around security measures.
  • Buqtivity's content (texts, photos, logos, software) is protected by intellectual property rights. Organisers warrant that they have the right to publish what they publish.

Liability

The organiser is responsible for running the activity, for safety during it and for the accuracy of the published description. Buqtivity is responsible for the proper working of the platform and for handling your booking and payment with the care of a diligent business.

Outdoor activities carry risks of their own (weather, terrain, physical effort). The organiser must warn you about them and take reasonable safety measures. [for the lawyer: the organiser's compulsory liability insurance and the requirements for activity leaders under the rules on tourism services.]

We do not guarantee that the platform is always available: maintenance or a fault may stop bookings for a while.

Nothing in these terms excludes or limits liability for damage caused intentionally or by gross negligence, for death or personal injury, or the rights you have as a consumer under the mandatory law of the Republic of Croatia and the European Union. [for the lawyer: the scope and wording of the limitation of liability (Croatian Civil Obligations Act, Art. 345; unfair terms under the Consumer Protection Act).]

Complaints, disputes, applicable law and changes

Complaints can be made in writing: by e-mail to [E-mail] or by post to [Address]. Give the order number and describe the problem. We confirm receipt without delay and answer within 15 days of receiving it (Croatian Consumer Protection Act, Art. 10). A complaint about how an activity was run is passed on to the organiser, and we follow it up.

Out-of-court dispute resolution. [for the lawyer: name the body for alternative resolution of consumer disputes and whether Buqtivity takes part in its procedure (Croatian Act on Alternative Consumer Dispute Resolution).]

The European Commission's online dispute resolution platform (ODR): ec.europa.eu/consumers/odr. [for the lawyer: the ODR platform was closed on 20 July 2025 (Regulation (EU) 2024/3228); check whether the link should stay.]

Applicable law and court. These terms are governed by the law of the Republic of Croatia. If you are a consumer living in another EU member state, you keep the protection of that state's mandatory law. Disputes go to the court competent for our registered seat; as a consumer you may also bring proceedings before the court of your domicile.

Changes to these terms. We may change these terms, e.g. for new features or new rules. The new version is published on this page with the date it applies from; account holders are told about significant changes by e-mail at least 15 days in advance. A booking always follows the terms in force when it was bought. [for the lawyer: the notice period for changes.]
